1. Agreement to Terms
By accessing or using Trifecta Gives Back, including the website trifectagivesback.com (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and AiN Collective (“we,” “our,” or “us”).
2. Description of Services
Trifecta Gives Back is a high-return fundraising program that connects customers, partner organizations, and the community. Customers purchase oil change packages; 60% of each package sale supports the customer’s chosen partner organization and 40% supports the Stranded Motorist Fund.
Our Services enable:
- Customers to purchase oil change packages that benefit an organization they choose
- Partner organizations to raise funds through package sales to their supporters
- The community to benefit through contributions to the Stranded Motorist Fund
- Packages to be redeemed at participating Adam & Son Auto Repair locations
3. Account Registration
To access certain features of our Services, you may need to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. User Conduct
When using our Services, you agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Submit false or misleading information
- Engage in fraudulent activities
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of our Services
- Use automated systems to access our Services without permission
- Collect user information without consent
5. Customer Terms
If you purchase a package, you additionally agree that package purchases are subject to the redemption terms, package details, and refund policy presented at checkout. Packages are redeemed at participating Adam & Son Auto Repair locations in accordance with those terms.
6. Organization Terms
If you register as a partner organization, you additionally agree to:
- Provide accurate organizational information
- Maintain your tax-exempt or charitable status (if applicable)
- Use funds in accordance with your stated mission
- Comply with all applicable charitable solicitation laws
7. Intellectual Property
The Services, including all content, features, and functionality, are owned by AiN Collective and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AiN COLLECTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
10. Indemnification
You agree to indemnify and hold harmless AiN Collective and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
